Beg, Borrow and Deal eligibility requirements


1. INTRODUCTION:
ESPN is inviting you, the viewer, to become a part of the action as it unveils a new reality-based game show - "Beg, Borrow and Deal"

ESPN is currently seeking contestants ("Contestants") who will work together as a team in a race across the United States. Those chosen to participate in one of two teams will start with nothing except the clothes on their backs and a driver's license. The goal of each team will be, using only money earned through "minimum-wage" employment or non-cash resources that a Contestant is able to obtain from third parties, to finish 12 sports-related tasks ("Tasks") chosen by the team from a list of approximately 50 Tasks.

The winning team will receive two tickets per person to certain major sporting events, to be determined prior to selection of the Finalists for Contestants.

Casting is now underway for clever, athletic and adventuresome adults over the age of 21 who are seeking a challenge.

If you're interested in participating, you must first read the form below. After you're done with that, you'll need to fill out our application/questionnaire and send it in with an audition tape (that meets the requirements listed below) to:

2. ELIGIBILITY REQUIREMENTS:

Applicants must comply with all of the following eligibility requirements for "Beg, Borrow and Deal":

A. Employees, officers, directors and agents of ESPN, Inc., ABC, Inc., The Walt Disney Company, the Hearst Corporation, Broken Twig Productions, Inc. (the "Producer") and/or of any of their respective licensees, assigns, parents, affiliated and subsidiary companies and the immediate family (spouse, mother, father, sister, brother, daughter or son, regardless of where they live) or members of the same households (whether related or not) of such employees, officers, directors and agents are not eligible to be Contestants on "Beg, Borrow and Deal" or participate in this application process. In addition, any person closely acquainted with any person connected with the production or administration of the program anticipated to be made of the Game and related material (the "Program") is not eligible, if in the Producer's sole discretion, the person's participation could create the appearance of impropriety.
B. Applicants may not presently be a legally qualified candidate for any type of political office ("Candidate") and may not become a Candidate from the time the application is submitted until one (1) year after telecast of the final episode of the Program (if the applicant becomes a Contestant).
C. All applicants must have a driver's license issued by one of the 50 United States valid through the end of the year 2001, automobile liability insurance covering applicant's use of non-owned motor vehicles and health insurance.
D. All applicants must be at least 21 years of age at the time of application.
E. Applicants must never have been charged with a felony or misdemeanor, other than minor traffic violations. Applicants must never have had a restraining order entered against them.
F. All applicants must be United States citizens and be living in the United States.
G. All applicants must be in good physical and mental health, and must be aware and sign releases attesting to the fact that the activities in the Program may involve risks and hazards, that participating in the Program may expose applicant and other participants to the risk of death, serious injury, and property damage, that applicants must accept and assume all such risks, and release Producer, ESPN, and their parents, subsidiaries, related entities and their respective agents and employees, and other persons or entities connected with the Program from any liability arising in any way therefrom or otherwise from their participation in the Program.
H. Any applicant who has appeared on any national broadcast or cable network primetime television reality/game show (e.g., Survivor, Big Brother, Fear Factor, Who Wants To Be A Millionaire, Greed, 21, Winning Lines, The Weakest Link, Bands on the Run, Blind Date, Boot Camp, Chains of Love, Eco-Challenge, Love Cruise, Making The Band, The Mole, Murder in Small Town, Popstars, The Real World, Road Rules, Spy TV, Temptation Island, Ultimate Reality, Wanted, Who Wants To Marry A Multi-Millionaire, WWF Tough Enough, You Don't Know Jack, etc.; not Jeopardy, Wheel of Fortune, Hollywood Squares, Family Feud, etc.) that (i) has been telecast during primetime within one (1) year prior to the Application Deadline date or (ii) is intended to be telecast during primetime within one (1) year after the Application Deadline date is not eligible.
I. All applicants who are selected as finalists ("Finalists") must be available to travel to Bristol, Connecticut for approximately 4 days in or about September 2001 for further interviews and qualification procedures. All dates are subject to change at Producer's sole discretion.
J. All Finalists must complete and timely return the "Finalist Package," which will include, among other things, a Medical History Form, Medical Authorization, Name and Likeness Agreement, Release Forms and Waivers for Finalists and their family members, Medical Release Form, Release of Records Form, Questionnaire, Confidentiality Agreement, General Release and Indemnity Agreement, and any other authorizations, release forms and waivers as Producer may require (all forms will be furnished to the Finalists). In the Release Forms and Waivers, the Finalist agrees, among other things, to assume the risk of, and release Producer, ESPN, and their parents, subsidiaries, related entities and their respective agents and employees, and other persons or entities connected with the Program from any liability for, any and all injury, illness, damage, loss, or harm to Finalist and Finalist's property, howsoever caused, resulting from or arising out of the selection of Contestants, Contestant's participation in the Program, and/or the production and/or exploitation of the Program.
K. All Finalists will be required to undergo physical and psychological examinations and testing (to be conducted in Bristol, Connecticut by trained personnel selected by the Producer) and meet all physical and psychological requirements, as set by Producer in its sole discretion.
L. All Finalists must authorize Producer to conduct a background check including, in Producer's sole discretion and without limitation, checks of employment history, driving record, criminal background, civil litigation and/or a credit check.
M. Upon Producer's request, all Contestants agree to sign any additional releases or authorizations that Producer in its sole discretion deems necessary.
N. Finalists shall treat all information and material received or acquired during participation in the Contestant selection process and Program, including without limitation, selection process, locations, tests, procedures, questions, materials, identity of other Finalists and Contestants as strictly confidential and shall not disclose any such information to any third party.
O. All Contestants selected must be available to travel and participate in "Beg, Borrow and Deal" for approximately six (6) consecutive weeks during September and October 2001. All dates are subject to change at Producer's sole discretion. Contestants will also agree to make a reasonable number of personal appearances and to participate in other reasonable publicity activities on behalf of ESPN and affiliated entities, for which they will be reimbursed for travel, lodging and food, but will not otherwise receive any remuneration or consideration.
P. All Contestants must agree to live, work, travel, participate in Tasks and cooperate with the other Contestants on his or her team and the Producer prior to, during and for a reasonable time after the conduct of the Game (including making personal appearances and participating in other reasonable publicity activities as described in paragraph O, above. Contestants acknowledge that they will be provided with no resources to accomplish the Tasks, to travel from a United Stated East Coast location to the locations of the Tasks and to the location of Task verification on the United States West Coast and to otherwise participate in the Program. Thus, each Contestant must be able to travel for long periods of time under unpredictable and physically and mentally taxing conditions, must be adaptable to various living and working situations, and must enjoy working and living in close proximity with others of varied age, sex, race, background, and experience. Contestants are subject to search by Producer at any time for any reason including for illegal or inappropriate items and ESPN Standards and Practices purposes. All actions of Finalists and Contestants - including those that might be regarded as private - may be videotaped or otherwise recorded on a 24-hour per day, seven-day per week, basis throughout the application process and the Game and immediately thereafter.
Q. All Contestants must abide by all applicable laws prior to and during the conduct of the Game. Violation of any applicable law is grounds for immediate disqualification from the Program.

3. HOW TO ENTER: A. Only one (1) application per person. Applicants must meet all Eligibility Requirements and may apply as follows:

(1) Complete this Application Form (including the Contestant Questionnaire and signed Name and Likeness Release). Applications MUST be written clearly or typed.

(2) Record a videotape of yourself, which meets the following restrictions:
(a) LENGTH: Up to THREE MINUTES. Anything over three minutes will not be considered.
ii. FORMAT: VHS ONLY.
iii. CONTENT: Who are you and why would you be a good Contestant on "Beg, Borrow and Deal"?
iv. LABEL: The videotape must be labeled clearly with your name, address, age, e-mail address, and all of your phone numbers.
v. The videotape becomes the sole property of Producer and will not be returned to you, whether or not you are selected as a Contestant, and may be used by Producer in any manner in any media.
c. Include a small photo of yourself.
d. Mail the Application Form (including Contestant Questionnaire, signed Name and Likeness Release, labeled videotape, and photo) to the following address:

e. The application with all application materials must be received by August 25, 2001.

B. Producer reserves the right to make additions to and/or deletions from the application process above. Producer also reserves the right to contact applicants to ask additional questions and/or conduct phone interviews to gather additional information about applicants. Such phone interviews are at the Producer's sole discretion to assist in gathering information for Contestant selection (see CONTESTANT SELECTION below). Producer may record any or all of such conversations and such recordings become the sole property of Producer and, whether or not you are selected as a Contestant, may be used by Producer in any manner in any media.

C. Producer is not responsible for lost, stolen, or incorrectly mailed applications. Due to the high volume of applications Producer is anticipating, Producer will not be able to answer any questions about the receipt or status of any application or videotape. All applications become the sole property of Producer.

4. CONTESTANT SELECTION: A. The Finalists will be flown to Hartford, Connecticut and then brought by ground transportation to Bristol, Connecticut for final interviews for approximately four days in or about September 2001 (or if in or near the Bristol, Connecticut area, will travel via ground transportation). All dates are subject to change at Producer's sole discretion. Producer will provide round-trip economy airfare (or pre-approved ground transportation expenses) and accommodations for each Finalist.

B. Each Finalist will receive a Finalist Package which will include, among other things, the following: Medical History Form, Medical Authorization, Name and Likeness Agreement, Release Forms and Waivers for Finalists and their family members, Medical Release Form, Release of Records Form, Questionnaire, Confidentiality Agreement, General Release and Indemnity Agreement, and any other authorizations, release forms and waivers as Producer may require (collectively, "Materials"). All Finalists must complete, sign and return all Materials and provide a photocopy or proof of a valid driver's license issued by one of the fifty United States, together with proof of automobile liability insurance covering applicant's use of non-owned motor vehicles as well as health insurance, to Producer to be considered for selection as a Contestant. Finalists must assure that Producer receives all Materials prior to the date designated for travel to Bristol, Connecticut. Producer reserves the right to augment and/or change the Finalist Package prior to issue. Producer is not responsible for lost, stolen, or incorrectly mailed Materials. All Materials become the sole property of Producer.

C. Producer will decide, at its sole discretion, using the guidelines set forth herein, which applicants will be called back to attend Finalist interviews and other qualifying procedures for approximately four days in or about September 2001. All dates are subject to change at Producer's sole discretion. Producer will notify applicants by telephone when and if they are selected to be a Finalist. Producer or Producer's agents will interview all Finalists in person. All Finalists must present the results of a full physical examination conducted by their personal physician prior to travel to Bristol, Connecticut, and must also undergo physical and mental examinations in Bristol, Connecticut, conducted by medical personnel selected by the Producer. If a Finalist does not meet all physical and mental requirements, does not sign or have executed all Releases and documents in the Finalist Package, and/or does not meet all Eligibility Requirements, then that Finalist will not be eligible to be a Contestant. Eight (8) Contestants will be chosen at the sole discretion of Producer to participate in "Beg, Borrow and Deal"

D. Selection of Finalists and Contestants shall be made by Producer based on such criteria as Producer shall determine, which may be subjective. Producer is selecting Finalists and Contestants which it determines in its sole discretion to be, among other things, outgoing, adventurous, clever and resourceful, physically and mentally fit, and to have interesting and diverse life styles and personalities. Producer is not obligated to select anyone, even if someone meets all eligibility requirements and all criteria for selection. Producer's decision regarding the selection of Finalists and Contestants is final and not subject to challenge or appeal. Producer is not obligated to have any Contestant appear on the Program and Producer shall have the right at all times and in its sole discretion to remove or replace any Contestant in connection with the Program for any reason or no reason. Even if a Contestant participates on the Program or any part thereof, Producer is not obligated to telecast or otherwise use or exploit the Program or any part thereof.

E. By entering, each applicant agrees to release, discharge and hold harmless the Producer from all claims and damages arising out of his/her participation in the Game and the Program, and to authorize the use of his/her name, voice and likeness used at Producer's discretion as part of the Program, or as part of promotions for the Program in perpetuity, in any and all media now known or hereafter devised. Finalists will sign releases to this effect.

5. QUESTIONNAIRE (please attach additional sheets if necessary):
