Eligibility: The ("Promotion") is open to legal residents of the fifty (50) United States and the District of Columbia who are thirteen (13) years of age and older, currently participating in the FFL game ( FREE AND PREMIUM LEAGUES). Promotion is subject to all applicable federal, state and local laws. Entrants are responsible for ensuring that all contact information is up-to-date and accurate.
To Enter: Participate in the FFL 2009 game, and get Larry Fitzgerald into your active lineup!
Selection of Winner: On a weekly basis throughout the 2009 FFL season, for each pass reception that Larry Fitzgerald makes, Sponsor will randomly select one (1) winner from among all FFL owners who had Larry Fitzgerald in their active lineups during the week of the reception.
Prize: For every catch made by Larry Fitzgerald, we will be giving away a signed ball. Approximate Retail Value ("ARV") per signed autograph ball: $130.00.
Total ARV for all prizes: $15,000.
Limit one prize per user/email account during the Promotion.
Miscellaneous: Winners are responsible for any federal, state and local taxes, as well as any other costs and expenses associated with acceptance and use of prize not specified as covered as part of prize herein No transfer, assignment, cash redemption or substitution of prize (or portion of prize) is permitted, except by Sponsor, which reserves the right to substitute a prize (or applicable portion of prize) with one of comparable or greater value, as determined by Sponsor. Potential winners will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within five (5) days of date of issuance of notification. Non-compliance with the foregoing or with these Official Rules may result in disqualification and, at Sponsor's sole discretion, the awarding of prize to the next runner-up. Designation of winner is subject to verification of the Affidavit/Release. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and judges, which are final and binding and agree that: 1.) Released Parties and their designees may use (unless prohibited by law) their name, voice, city/state of residence, photograph and/or likeness for advertising and/or trade and/or for any other purpose in any media or format now or hereafter known, worldwide in perpetuity, without further compensation, permission or notification, and 2.) Released Parties and their designees and assigns shall have no liability and will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize (including any travel/activity related thereto) or participation in this Promotion. Sponsor reserves the right, in its sole discretion, to modify, suspend or terminate this Promotion (or any portion thereof) should virus, bugs, non-authorized human intervention or other causes, including but not limited to war or armed conflict (whether or not officially declared), labor controversy or threat thereof, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Promotion and, in the event of termination, at its discretion, select winner from among all eligible, non-suspect entries received as of the date of the event requiring such termination. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES (INCLUDING ATTORNEYS' FEES) AND DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
Potential Winners. ALL POTENTIAL WINNING PLAYS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL. SPONSOR SHALL SOLELY DETERMINE ANY FORM OF VERIFICATION. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT'S ELIBIGILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS, AFFIDAVITS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY ENTRY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON MAY BE DEEMED A DEFECTIVE ENTRY AND VOID. A potential winner will be disqualified and an alternate potential winner will be selected (i.e., the person with the next most points) if (i) he/she does not comply with these rules (or is otherwise determined to be ineligible), (ii) he/she does not respond to the prize notice within five (5) days of its transmission (or receipt, if mailed), or if the emailed prize notice, after three (3) attempts, is returned as undeliverable, or (iii) the prize is undeliverable for any reason. If Sponsor notifies, or seeks to deliver a prize to or otherwise attempts to contact an alternate potential winner, and such alternate potential winner is subsequently disqualified then Sponsor shall use its reasonable business judgment to determine, in its sole discretion, the disposition of the prize (e.g., may choose another alternate potential winner in a manner consistent with these rules or donate the prize to another entity, at its sole discretion). Potential winners will be notified via email (or overnight mail) sent within fifteen (15) business days following the end of the Promotion.
Winners should allow up to 6-12 weeks after they return their signed, notarized affidavit to receive their prize. Prizes returned as undeliverable or otherwise not claimed within fourteen (14) days after being sent will be forfeited.
E-mail Change of Address Policy: It is the sole responsibility of the entrant to notify the Sponsor during the Promotion if his or her email address changes. To do so, click on the "myESPN" link on any ESPN.com fantasy game page, then click on the Account Information link and follow the instructions.
Disputes/Choice of Law: Except where prohibited, each entrant agrees that: (i) all issues and questions concerning these Official Rules shall be governed by New York law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Promotion or any prize awarded shall be (A) resolved individually, without resort to any form of class action; and (B) filed only in the state or federal courts situated in New York County, New York state, i.e., Manhattan, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (iv) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Privacy: Personally identifiable information that is submitted by entrants as part of this Promotion will be used to administer the Promotion, select the prize winner and fulfill the prize, and will be treated in accordance with Sponsor's privacy policy accessible on its website at www.espn.com.
